LEGAL NOTICE, TERMS & BUSINESS POLICIES

Welcome to Bozeman’s Lures. By accessing our website, purchasing our products, placing a custom order, communicating with our business, or otherwise interacting with Bozeman’s Lures, you acknowledge and agree to the terms and notices outlined below.

Bozeman’s Lures is an independently operated business specializing in handcrafted, custom-painted fishing lures and related products. Each product represents original creative work, time, materials, craftsmanship, and intellectual property.

Please read this notice carefully.

1. INTELLECTUAL PROPERTY & ORIGINAL DESIGNS

All original artwork, lure patterns, color combinations, paint schemes, concepts, graphics, logos, photographs, videos, written content, product names, branding, and other creative materials produced or published by Bozeman’s Lures are the property of Bozeman’s Lures unless otherwise stated.

No person or business is authorized to copy, reproduce, trace, duplicate, modify, distribute, sell, advertise, or commercially exploit Bozeman’s Lures’ original artwork, designs, photographs, branding, or other creative content without prior written permission.

Purchasing a lure from Bozeman’s Lures does not transfer ownership of the underlying artwork, design, concept, pattern, or intellectual property.

The physical product purchased by a customer belongs to that customer. The intellectual property associated with the artwork and original design remains with Bozeman’s Lures unless a separate written agreement states otherwise.

2. NO UNAUTHORIZED COPYING OR REPRODUCTION

Customers, competitors, artists, businesses, and other individuals may not use Bozeman’s Lures’ original designs as templates or references for the purpose of reproducing substantially similar products for commercial purposes without written authorization.

This includes, but is not limited to:

Tracing or recreating original paint schemes
Reproducing original artwork
Copying unique color patterns or combinations
Recreating custom designs for resale
Using Bozeman’s Lures photographs to advertise another product
Removing or altering Bozeman’s Lures branding or watermarks
Creating substantially similar products for commercial sale
Representing another person’s reproduction as original work
Using Bozeman’s Lures designs in advertising or promotional material without permission

Bozeman’s Lures reserves all rights available under applicable intellectual-property laws.

3. PHOTOGRAPHS, VIDEOS & ONLINE CONTENT

All photographs, videos, product images, promotional materials, written descriptions, graphics, logos, and other original content published by Bozeman’s Lures are protected to the extent provided by applicable law.

Unless permission has been granted, this content may not be copied, downloaded for commercial use, reposted as if it were another business’s content, altered, or used to promote competing products.

Sharing a Bozeman’s Lures post through a platform’s normal built-in sharing functionality is different from copying and commercially reproducing our content.

4. CUSTOMER-PROVIDED DESIGNS & CUSTOM ORDERS

Customers requesting custom work are responsible for ensuring that any artwork, logos, photographs, trademarks, or other materials they provide to Bozeman’s Lures are materials they have the right to use.

By submitting materials for a custom order, the customer represents that they have the necessary rights or authorization to request the work.

Bozeman’s Lures reserves the right to decline a custom request if we believe the request may infringe upon another person’s intellectual property, violate applicable law, or create an unreasonable legal or business risk.

5. HANDCRAFTED PRODUCTS

Bozeman’s Lures products are individually handcrafted and painted.

Because each lure is created by hand, minor differences in paint, finish, color placement, texture, patterns, and other details may occur.

These variations are a normal characteristic of handcrafted products and are not necessarily defects.

Product photographs may also appear slightly different depending on lighting, photography equipment, screen settings, and other conditions.

6. PRODUCT USE & FISHING

Bozeman’s Lures products are designed for fishing and recreational use.

Customers are responsible for using products appropriately and safely, including selecting appropriate equipment, hooks, split rings, line, tackle, and fishing locations.

Bozeman’s Lures is not responsible for injury, property damage, equipment damage, or other loss resulting from improper use, modification, misuse, neglect, or failure to follow reasonable safety practices.

Fishing involves inherent risks. Customers are responsible for complying with all applicable fishing regulations, licensing requirements, size limits, seasonal restrictions, and other laws governing the waters where they fish.

7. ORDERS & PURCHASES

Customers are responsible for reviewing their order information before completing a purchase.

This includes product selection, quantity, color or pattern selection, personalization, shipping information, and other applicable order details.

Bozeman’s Lures reserves the right to correct obvious pricing, listing, description, inventory, or technical errors.

An order may not be changed or canceled after production, customization, packaging, or shipment has begun unless Bozeman’s Lures agrees otherwise.

8. CUSTOM ORDERS

Custom products are created specifically for individual customers and may require additional time for design, preparation, painting, drying, finishing, and quality control.

Because custom products are personalized, customers should carefully review and approve requested specifications before production begins.

Once production has started, changes may not be possible.

9. RETURNS, REFUNDS & DISPUTES

All returns, refunds, exchanges, cancellations, and warranty matters are subject to the specific policies published by Bozeman’s Lures at the time of purchase and applicable law.

Nothing contained in this notice is intended to eliminate or restrict any consumer right that cannot legally be waived.

Customers with legitimate concerns are encouraged to contact Bozeman’s Lures directly so that the matter can be reviewed and addressed appropriately.

10. SHIPPING & DELIVERY

Bozeman’s Lures will make reasonable efforts to process and ship orders within the timeframe communicated to the customer.

Once a package has been transferred to the shipping carrier, delivery is subject to the carrier’s handling, routing, delays, weather, operational issues, and other circumstances outside of Bozeman’s Lures’ direct control.

Customers are responsible for providing an accurate and complete shipping address.

11. CUSTOMER COMMUNICATION

Bozeman’s Lures welcomes questions, concerns, feedback, and reasonable requests for assistance.

Customers are expected to communicate respectfully.

Threatening, abusive, harassing, discriminatory, or repeatedly hostile communication will not be tolerated.

Bozeman’s Lures reserves the right, to the extent permitted by law, to discontinue communication, refuse future transactions, or take other appropriate action when a customer engages in abusive or threatening conduct.

12. BUSINESS DISCRETION

Bozeman’s Lures reserves the right to refuse or cancel an order, decline custom work, or discontinue a business relationship when permitted by applicable law.

This may include situations involving suspected fraud, unauthorized use of intellectual property, abusive conduct, repeated policy violations, or other circumstances that create an unreasonable risk to the business.

13. NO TRANSFER OF INTELLECTUAL PROPERTY

A purchase from Bozeman’s Lures does not grant the purchaser permission to reproduce the artwork, commercialize the design, manufacture copies, or use the design to create competing products.

The purchase is for the physical product only unless a separate written agreement expressly states otherwise.

14. ENFORCEMENT OF RIGHTS

Bozeman’s Lures reserves the right to take appropriate action against unauthorized use, reproduction, copying, distribution, or commercial exploitation of its intellectual property.

Where appropriate, this may include requesting removal of infringing material, issuing formal notices, reporting unauthorized content to applicable platforms, seeking available remedies, or pursuing legal action.

Nothing in this notice limits any rights or remedies available to Bozeman’s Lures under applicable federal, state, or other law.

15. NO WAIVER

Failure by Bozeman’s Lures to immediately enforce a particular policy, right, or provision does not constitute a waiver of that right or prevent Bozeman’s Lures from enforcing it in the future.

16. POLICY CHANGES

Bozeman’s Lures reserves the right to modify, update, or revise its policies, terms, and notices when necessary.

Updated versions may be posted through the Bozeman’s Lures website or other official business channels.

Questions regarding orders, custom work, intellectual property, policies, or other legitimate business matters should be directed to Bozeman’s Lures through an official business contact method.

Please provide sufficient information for the matter to be properly reviewed.

IMPORTANT NOTICE

Bozeman’s Lures takes pride in creating original, handcrafted products.

Our designs, artwork, concepts, and creative work represent substantial time, effort, experience, and investment. We welcome customers, collectors, anglers, and fellow artists who appreciate the craft and creativity behind custom-painted fishing lures.

At the same time, we take unauthorized copying, reproduction, misrepresentation, and commercial use of our original work seriously.

If you did not create it and do not have permission to use it, do not copy it, reproduce it, sell it, or represent it as your own.

Nothing in this notice is intended to create rights beyond those provided by applicable law, and nothing herein is intended to waive rights or protections that cannot legally be waived.
